If you continue to use and browse this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy outline our (Aweside Farm) relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

All content and programming of the website is our property. You may not reproduce, modify, copy, de-compile or reverse engineer any of the materials, software or content on the website without our written permission. 

Use of the website is restricted to personal, non-commercial use only.

You are responsible for maintaining the confidentiality of your account and password, for all activity that takes place on your account, and for restricting access to your computer. We can not be held liable for any loss or damage that may result from your failure to do so.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

Aweside Farm reserves all copyright of the content on our website and social media unless otherwise stated. 

All intellectual property rights in or relating to the website (including our text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned by us 

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following:

  • Printing or downloading to a hard disk for personal and non-commercial use
  • Seeking prior permissions to use our content

You may not, except with our written permission, distribute or commercially use our content. You may not store it on any other website or social media without our consent.

Disclaimer

The information on this website if for general information. While we endeavour to keep the information up to date and correct, and keep the availability of this website open all the time to meet your requirements and be fault free, sometimes things may slip, and if you do find any issues please do contact us and we will rectify the fault as soon as we can.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Allergies

We have thoroughly research edible flowers, however allergies can arise from edible flowers and we stress due caution if trying edible flowers for the first time. We will state if edible flowers come from a mustard or onion based family. Tulips are known to cause allergic reaction in people, so do try some first and seek medical advice.

We cannot accept liability for any illnesses or allergic reactions that occur due to eating edible flowers that you have bought through Aweside Farm. It is your responsibility to test and check for allergies. 

We recommend that stamen, calyx, stems should be removed before eating and that the petals are eaten.

Your account

In order to purchase products from the website, you can order via a guest account or register an account with us for future orders

To register an account you must agree to comply with these Terms and Conditions. 

If you are under 18 years of age and you order from the website, note that you are liable to pay and will be held responsible for your order.

If you are registering on behalf of an organisation or company you must have the authority to bind that company. 

To sign up, you need to provide your full name, a valid email address, the delivery address and a telephone number. When registering for an account, you warrant that to the best of your knowledge that all information you provide is true and accurate. It is your responsibility to ensure the information is kept up to date. You are responsible for all activities and purchases that occur under your account. You must notify us immediately if you suspect or have become aware of any unauthorised access or use of your account.

Product Availability

Items may be temporarily out of stock, this will be indicated by product at the ordering stage on the website. In extreme circumstances, products may not be available at the point of packing and therefore cannot be supplied. 

We will notify you as soon as possible, whether you want to change the item or hold off sending the order until said item becomes available.

If you ask us to send the item separately there will be an extra delivery cost to you the buyer. We will not send substitutes if a product is not available.

Purchases

Customers will pay the price of goods at the time of purchase. Prices can change without notice but any orders with a set price will be honoured. 

No order is accepted from you until our website displays an order confirmation message and email is sent to you.

The average weight and price shown is for guidance only; typically items are packed based on a count, this count may change throughout the season depending on the size of the product i.e. cornflowers get smaller later in the season, so we pack more into the punnets.

Some prices are based on weights. The weight you receive may vary from this guide and the price you are charged will be for the weight of Product delivered.

Payment

The price of the goods and any additional delivery or other charges is that set out on the website at the date of the order or such other price as we may agree in writing.

We use PAYPAL to ensure security and fraud protection for you. 

Payment is made via PayPal payment gateway. You can also pay with your debit or credit card as a Paypal guest, you do not need a Paypal account. Payments are subject to the PayPal legal agreements.

We can accept BACs if you contact us. We can also accept cash or take card payments for local pick ups from the farm but these must be arranged in advance.

Delivery

Our delivery FAQs outline the ins and outs of delivery. 

You will be able to choose a delivery date if you require one, use this to specify the date of your event and we will send the item out the day before if this is doable. 

The cost of delivery includes VAT.

In the event of a delivery not being delivered within the quoted time, the company shall not be liable for any losses, costs damages or expenses incurred to either the customer or a 3rd party. 

The actual delivery date may vary depending on stock availability, the location of the delivery address, the time you place your order and circumstances that may impact delivery by the courier.

You will not hold us responsible for any delays, outside our control, which relate to your delivery. It is your responsibility to report all lost or undelivered orders. If you change your address, you must ensure you update your address details before completing the order.

Please state in your notes if there is a safe place or neighbour your package can go to, otherwise it will not be delivered and they will try again the next day. Without this information and if a redelivery occurs the integrity of the package diminishes and we want to ensure that your package is out of the delivery cycle as soon as possible. We accept no responsibility for loss or damage to parcels that have been left in your designated safe place or if you have entered a wrong address for delivery.

Our deliveries are sent between Monday – Thurs. Saturday delivery can be arranged but on an adhoc basis and is a lot more expensive. Orders placed after Thursday 3pm will be processed on Sunday for a Monday pick up and Tuesday delivery.

Cancellations

Once your order has been placed and confirmed you have entered into a contract to buy the products from us. We will begin to process it either on the same day by booking in a delivery (if placed before 3pm) or the following morning. You must let us know asap if you would like to cancel your order, and we may only be able to do this if your order has not been booked in with the courier. 

Please contact us via phone or email if you require a cancellation.

If you order is placed several weeks in advance, you can cancel with 1 weeks notice up to the value of £30 (excluding courier cost).

Refunds

In the event you are dissatisfied with your item then please do contact us and we will resolve the matter at our discretion.

Force Majeure

We will not be liable to you for any lack of performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control.

Data protection & Privacy

We work on a non-disclosure basis, and do not pass on your information to third parties (except for the needs of product delivery). In order to process an order, we have to collect your name, address, e-mail address, telephone number.

  •  Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information.
  • These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy (https://awesidefarm.co.uk/privacy-policy/) and cookies policy (https://awesidefarm.co.uk/privacy-policy/).
  • For the purposes of these Terms and Conditions:
    • a.   ‘Data Protection Laws’ means any applicable law relating to the processing of Personal Data, including, but not limited to the Directive 95/46/EC (Data Protection Directive) or the GDPR.
    • b.   ‘GDPR’ means the General Data Protection Regulation (EU) 2016/679.
    • c.   ‘Data Controller’, ‘Personal Data’ and ‘Processing’ shall have the same meaning as in the GDPR.
  •  We are a Data Controller of the Personal Data we Process in providing Goods to you.
  •   Where you supply Personal Data to us so we can provide Goods to you, and we Process that Personal Data in the course of providing the Goods to you, we will comply with our obligations imposed by the Data Protection Laws:
    • a.   before or at the time of collecting Personal Data, we will identify the purposes for which information is being collected;
    • b.   we will only Process Personal Data for the purposes identified;
    • c.   we will respect your rights in relation to your Personal Data; and
    • d.   we will implement technical and organisational measures to ensure your Personal Data is secure.

Complaints

We try to avoid any dispute, so we deal with complaints in the following way: Should you have any complaints or feedback regarding any service or products that you have received from Aweside Farm, then please contact us. We will aim to acknowledge complaints within 48 hours. If you would prefer to write to us, you can do so at Aweside Farm, The Street, Arlington, Polegate, East Sussex, BN26 6RY.

Applicable Law

Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the laws of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the courts of England and Wales.

These terms and conditions do not affect your statutory rights.
